The US Supreme court will decide same sex marriage! Argument in April and a decision by June! The Sixth Circuit upheld the gay marriage ban in four states and now the time is right to decide. Two questions are up. First if all states must allow gay marriage. Second if a state must accept a gay marriage that is valid in another state.

The second question is easier. Generally full faith and credit requires states to accept decisions from other states. This US Constitution requirement has a long history. For example when Nevada started offering divorces for tourists who spent six weeks in Reno at a dude ranch, Maryland was forced to accept the result.

If Ohio has to accept a valid gay marriage from New York, what is the use of banning the same marriage in Ohio? My bet is the Supreme Court will finally say what is obvious. All adults have the right to marry.

Scalia was right in his dissent in the Texas<b> sodomy </font></b>case. Once you say a state cannot make private gay sex illegal, how can you disapprove of gay marriage? You cannot.

The latest dumb argument to try to justify the same sex ban is reproductive bonus. The argument is hard to follow. It goes something like this: we want to reward straight people who reproduce so we give them the bonus of marriage. There are many tax and subsidy benefits to marriage.

Gays cannot reproduce so we only reward straights with marriage. The many problems with this argument are obvious. We allow ninety year olds to marry. We allow sterile people to marry. We allow people who do not have sex and do not reproduce to marry. We also allow gay people to adopt or reproduce through sperm donors or surrogates. So we are rewarding straight people who do not reproduce and punish gay people who are raising .

The biggest whole in the anti-gay marriage argument is no one has been able to articulate any harm to straight people by allowing gay people to marry. The best they can argue is that history and tradition did not allow it so we should not make this change. Of course the US historically allowed slavery, wife-beating, labor, banned interracial marriage, did not allow women to vote, only allowed people over age 21 to vote, shipped American citizens of Japanese descent to relocation camps during WWII, etc.
